Faulty batch of Ace 250's (AND RETURNING FAULTY DETECTORS)

Hi ALL RESUBMITTED THIS AS THERE IS SOME GREAT ADVICE FOR PEOPLE WITH FAULTY DETECTORS & IT IS WELL WORTH READING

My Garrett Ace 250 which i bought early febuary has only been used about 5 or 6 times but the display panel is faulty.

You cannot see the sensitivity bars or the bottom two discrimination boxes on the left bottom corner.

So i phoned the shop i bought it from & they are fully aware of this problem saying they have had a faulty batch want me to send the controll box back AT MY EXPENCE as they know exactly how to rectify the fault but also that this batch may go faulty after a week,month, year or more as they dont know why it is happening!!!!!

Should they therefore not issue a recall on this batch or at least inform us that if this fault occurs they will honour the warranty even if it has expired.

serial no on my unit is 50410893 if it helps to narrow down this batch

Sale of goods act: The merchant is responsible for the goods he sells. It's the shop who should either replace it or refund your money. Do not take any BS from them - it's their job to ensure the goods that they sell are fit for the purpose for which they are sold. You have informed the shop of the problem, and if it's an internet shop ask them how THEY intend to collect it, and if it's a normal shop, take it back to them.
If they don't do the honest thing, either post their name here, or PM me, and I will go see them.
I get my dander up when folk get ripped off. And they won't like me when my dander is up :D

Yep,the man`s right.Have you tried trading standards?They are usually very helpful.Try contacting the shop again and mention trading standards,they shouldn`t expect you to pay for the return postage if it`s a faulty batch if you`d stood on it or chucked it in a hedge and bust it that`d be different.

Thanks uncle Phil think i will phone back & try to clarify it with them.

I bought it online so it is not feasable for me to return it in person as i live near derby & the shop is in the West Mids it would be a 100 mile round trip & petrol would cost more than postage.

But i certainly think they should send me a prepaid return package or something along those lines.

Just looking round the forum...have you tried new batteries,factory reset,make sure the coil cable is secure?Just a thought..

Yeah tried all the usual fixes but no joy.

The guy at the shop finished my sentance for me when i was telling him the fault so he must have come across it several times.

I will keep you posted on my progress.

Distance selling rules now state that the seller must refund/pay for your postage if the unit is deemed to be faulty, more so for a batch fault. There are also rules about product being fit for the purpose, do a call the citizens advice, they will tell you where you stand

I've had dealings regarding the Sale of Goods act, Dave, and the advice you give is spot on. Those who try to pull the wool over their customers eyes will always deny their responsibility, until you threaten them with the Sale of Goods act. Believe me, they know all about it, but they will try it on in case they can get away with it. ;)

Great advice Bulldog & yes you are are right about the shop i bought it from.

Looks like i am left with the dirty end of the stick here so i may phone Garrett & make sure these were not wholesaled as graded stock &/or should have been returned.

I am certainly not happy that i have knowingly been sold stock from a faulty batch & may explore the legality of this aswell.

but under the distance act don't come into it now

11. Consumer Protection (Distance Selling) Regulations 2000. If the Buyer orders the Goods from the Seller by telephone, internet or fax it has additional consumer rights. In such circumstances the Buyer may return the Goods at its own cost within seven (7) days from receipt of the Goods on condition that the Goods are unused. The Seller will refund the price of the Goods provided that they are returned suitably packaged and in an unused condition with their original packaging. If the Goods have been used in any way they will be deemed to have been accepted by the Buyer. The Consumer Protection (Distance Selling) Regulations 2000 do not affect the Buyer’s statutory rights under the Sale of Goods Act 1979.

Sending the goods back
Unless you have bought the goods under a distance selling contract, you won’t have any legal right to send the goods back if you have simply changed your mind. You should refer to that retailer’s return policy and will probably have to pay postage. If the goods have arrived damaged, and you have been offered requested a repair or a replacement, you should not have to pay any further sums of money in this respect. This includes labour, materials or postage. The repair / replacement should take place in ‘reasonable time’ and you should not experience any ’significant inconvenience’, while you are without it/them. For more on this, see our section on Sale of Goods and Returning Damaged or Faulty Goods.
Wrong wrong wrong wrong. The goods are faulty so it is the seller's responsibility to arrange collection and replacement. If the goods were bought on the internet, then that itself constitutes a "distance selling contract".
He hasn't changed his mind, he can't use the item so it's not his fault. I have had a lot of experience with sellers and consumer protection legislation.

I misinterpreted this bit, which I understood to mean that the act no longer applies

I don't know how much experience you have with the selling regulations, so wouldn't dream of attempting any kind of infantile "I-know-better-than-you" rubbish, but rest assured, I do have fairly extensive experience in that direction.
