should friends have contract ???

Surely the best thing to do in advance is just say` If you find anything, you can keep it, if it`s of any value then we go 50/50. If not, just don`t invite others onto your permission.! ;)

ok gregg i am spinning again lol here we go its your permission you have had it for years you decide to help someone out for a day on your land not a friend just an aquaintance you find a hoard whooops its worth a million are you going to give this guy 250.000 thousand pounds for agreeing to come out detecting for a day I THINK NOT OOOOHHHH GRRRRRRRR HEHEHE

That sums it all up. Everything is sweet until you find that special coin/hoard/artefact that has real value. If your guest finds it, you would expect to be in charge of who gets what. If YOU find it, your guest may expect a share as he was with you. The landowner is ok, he still gets his 50%.
It all starts to turn to ratshit if you expect people to be honest and reasonable, that is why someone a long time ago invented a thing called a contract.
Get the contract done and out of the way, hoping it will never be needed. You can then relax into the detecting and even decline to take the unwanted friends as you can explain that they "are not on the contract" =)) =)) =)) Liam, no hoard found today, but a big addition to my button museum. :(

Good post Greg... and one definately worth thinking about.

For me, this problem will never arise. I always detect alone, therefore the only person trying to get their hands on the money, would be the wife!! =))

I sometimes tect with a friend......we have a verbal agreement we made at the start....
If i find something that has to be sold on his land then farmer 50%, me 25% and him 25%
Same applys to anything he finds on my land that has to be sold....

Money and fame will corrupt the strongest of friendships....
Just look at the relationship between the farmer and the guy that found the staffs hoard....
You would have thought they would be friends for life.....

A problem that sometimes arises is when you invite a person onto your land for an afternoon as part of a friendly gesture and maybe you would later be invited onto his land and so on. Then later on you find evidence that he has been back onto your land by himself and not leaving it in the state you would have. Apart from your good relationships with landowners fragmenting rapidly - we are only as good as our last unfilled hole - he would be unlikely to declare anything of value.
A contract not only sets out exactly what the division of spoils will be, but just as importantly it controls legal access to the land. If your friend is a friend in the real sense, then he will not have any problems signing up. It works as much for him as anyone else. One "friend" invited onto your land will have ten more mates half expecting to get on there as well later on.

Great post Greg thanks for posting the topic, it's one that clearly needed talking out.
I am lucky not to have this dilema as I detect alone as I enjoy the rare solitude it gives, but if I was to take someone it would be the 50% landowner 25% friend and 25% me handshake agreement.

Even if it makes others aware and they come to a verbal agreement...then at least this topic was worth posting ...it all comes down to trust......I personally detect alone so it dosent affect me.....but there are posts on here where land share is proposed..and accepted ....thats why I posed the question because I wanted to find out if an agreement were made .....I would be gutted if I was allowed to go on someones permission and then went on to find something of value only to told ..thats not yours to share as sugar suggested in an earlier post :)
If I was to live to over 300 years old , would I end up in a museum ?

before you expect someone who finds something on your permission to share with (or give you as some people seem to expect) anything of value that they find. think whether you are willing to do the same with them. after all you don't own the land and there is no guarantee you would have ever found what they did anyway!

i would say a contract isn't a bad idea but remember the door swings both ways and if you expect someone to singe a contract that gives up there claim to anything of value.... i think you might be being a bit wishful! 8-}
