what are the rules ion river detecting

Post by scottyhound »

Hi all
I live very close to and old roman settlement that has produced some good finds foor many people over the years ( unfortunately not me as never managed to get any permission to get on any of the fields) but there is a river that runs all through the said area and I know that from being into fishing that certain areas are private club waters but lots of it is free fishing areas.
Does this mean if you can fish that I could get in the river and on the banks of these areas and detect it. Any help on this would be appreciated.
Thanks all.

Fishing and metal detecting can`t really compare I`m afraid when it comes to permission. I could pop down to the local beach and fish, but I can`t metal detect there. I would imagine that you would need the permission of the landowner whose land the river runs through. 8-|

Simple answer is no, landowners have what are called Raparian Rights over the river bed, to detect you would need permission from the landowner ::g

This was my first thoughts aswell the areas im talking about will im sure be owned by someone but im pretty sure it will be local authority or main council so maybe I need to speak with these im sure I know what the answer will be but no harm in trying.

riparian rights means others (the landowners on each side )most likely own the river to the centre point .

thanks for the info, I was always under the impression that no land owners own rivers that pass through there land as these are all owned by threapart state who own all waterways and landowners only own the banks on which side there land is on, I could be completely wrong but being in fishing circles its what ive heard a few times over the years, think a bit of research is required.

People can have fishing rights etc to a stretch of river, but they don't own the actual water, which is why you can sail a boat on a river but if you land on the banks you are trespassing. Its the river bed that landowners have control over ::g

having had rows with landowners whos river bed i was digging i can confirm they own the bed of the river as they were adamant i leave right away .
or a water company can own the riverbed as well , i had a row with the manager of the local water company who told me to stop digging and leave ,i was digging the river in St Albans

Thanks owain very helpful.
Targets I was referring about a river in St.albans maybe its the same stretch this one is in wheathamstead should be a good area with all its history and I cant seem to get on any land in the area so thought the river was a good option. Im struggling a bit at the moment trying to get any permission in the area or anywhere in herts. Had a knock back today from the cecil estate at hatfield house. but will keep trying other options.
